your lights should always work with the key in on position for safety reasons, eg if you had to pull over and it was dark you would turn the engine off but would still need lights.
Is the headlight itself new? You can hook up any 12 volt source to the headlight prongs and tell if the bulb itself is burned out...take it out and test it !...good luck to you....Tim
