Question about Sony Handycam DCR-SR40 Camcorder
When files are deleted they still remain on camcorder hard drive and can
be recovered, unless they have been overwritten by fresh data.
The only thing to do so run a data recovery program to see what can be recovered. The only program I have tested is asoftech data recovery software and it had done the job well. download the data recovery from http://www.asoftech.com/adr/
Select the drive where your files were deleted and then do a deep scan. It will find your deleted files.

You can recover the deleted videos as long as the data are not overwritten.
Deleting files(such as videos or photos) from camcorder is just like clearing the recycle bin or Trash on your comptuter. The data itself isn't deleted, just the area containing the deleted data is also now marked as free space so it is available for any new data to be written there instead. The REAL data is still there. As a result a simple delete won't make your videos erased permanently.
Then you need opt for a third party data recovery software.
If you are running Windows, try this software(recover photos, VIDEOS and music)
For Apple Mac OS X, try this Mac data recovery software.
Install the program on your computer (choose the right version based on the operation system you are running), then connect your camcorder (memory card or HDD) to the computer and start to recover your deleted videos. I am sure you can operate the recovery on your own. Good luck.

The deleting process won't let the files

Your videos is not wiped off permanently after the delete. Only the space is made available to other new files, but the old data is still there. In another word, deleted file can be recovered as long as the space is not overwritten by new files. you could tryCard Data Recoverywhich will help you recover videos without casusing any data damage to your videos.

If a file has actually been "overwritten" and not just "deleted" then no your photos are toast. Had they been deleted you may of had a chance. However you might want to attempt to use a program such as Tenorshare Data Recovery and try and recover your pictures. I have used it to recover deleted photos from samsung galaxy I doubt it will find anything that is actually recoverable but it never hurts to try
