2004 Land Rover Freelander TD4. Could an auto 2004 g/box be fitted to a 2013 Freelander TD4?

Wikipedia is usually the best place to work this out.

Although both TD 4, your 2004 is first generation.
  • 2.0-litre I4 BMW M47 diesel (2001-2006), badged as 'TD4'
But the 2013 is second generation and Ford based, but still TD4 or SD4

Oil coming out of gearbox apparently on 05 freelander td4. do I require a new gearbox or can this be fixed?

That depends from where the leak is coming: it can be as simple as an loose drain plug, could get worse if it's a worn seal or can be terminal if the gearbox's case is fissured. Put the SUV on stands, clean the gearbox, start the engine at idle, put it into a gear (3 or 4 will do) and look from where the oil is coming.

Automatic gearbox out of order. Oil black and burned. I will shift to a new one. Do I need to shift the torque converter as well?

if i was you i would change the torque converter its the safest bet, the box must have been very low on oil and maybe slipping for a time to burn the oil black!!!
however you may still get away with cleaning the internal filter and just flushing the old box out with ATF and refilling it with fresh ATF oil
yes,,its been cooked up, but mine still worked for years after i cooked it up and it changed much smother after that too??
