Can't stand my tv straight up.

Stands are not generally available for TVs. The makers do not provide spare parts inventory. Your best bet would be to go to the store you bought it from and see if they have any returns of your product that they can steal the stand from.

If you follow the two post that are coming up from the stand there are tw screws on each post holding it to the tv.

By the way, your tv is a rebranded Samsung model.
Without the stand, you only option would be to wall mount the tv.
You can purchase a wall mount for your tv from your local Wal-Mart or something to that effect for around $30.
