You should never use a seat in a way that it is not intended. I would have to know the specific model you have, but the headrests are adjustable up and down and are intended to protect the sides of the child's head in an accident. If the foam underneath is broken, you should contact Britax and they can send you a replacement foam. Per their website: The seat is still structurally safe to use as long as the foam is positioned in the same place in which it was intended.
