If you pull the silver knob on the tub spout up, the diverter located located inside will redirect water up to the shower head and when lowered it will return the water to the tub spout. It sounds as thought the diverter is not working properly. Hope this helps..
During construction did you perhaps close off a shut off valve within the water line and not reopen it? If not do you hear anything at all when you turn the shower faucet on? Let me know.
It sounds like the seals are going bad. Moen is probably rebuildable. You can go to a Menards and ask if they have the replacement guts for your particular model.
take out the cartridge from the fixture and make sure it has all of the "O" rings and stoppers.
look at the instruction again, make sue you are installing it the right side up. if all that, the shower still leak, then you need to talk to the place you brought the fixture, it may have a defective cartridge.
