If you ahve the IMEI code of your phone and the proof of your purchase then you can lodge a complaint to the nearest police station so that the matter is reffered to a cyber cell. They may be able to trace if anyone is using your phone as the IMEI number can be traced. But then you will have to go through all the proceedings and maybe waste some time to go after such procedures. So do accordingly accordingg to your need. Good day

The right way to get back your mobile is to report the loss of mobile to your service provider, and approach the CYBER CRIME wing of Police dept in your city. They jave a special cell to recover lost mobiles using IMEI number tracking in co-ordination with all Mobile Service providers. you may have to make few rounds to police station, but its worth as they sure track the mobiles.
