to update to iOS 5 is only possible on iPhone 3GS / 4 / 4S with connecting the device to iTunes on a computer.

To be able to
access the root directory of your iPhone without using wifi, you need to
download iPhone Explorer. It's a free app that is the equivalent of
Winscp for people with wifi connection. With this, you just need an
iPhone usb cable. <br />

Assuming you already have the folder of the theme you just downloaded,
just copy and paste it on the themes directory of the iPhone located in
Root/Var/Stash/Themes<br />
5. Once done, open Winterboard to install the theme, select then Respring. <br /><br />
I believe this to be an orientation lock, which locks screen rotation. To toggle on or off, first double click the home button to reach the multitask bar, then swipe right. You should find it to the left of the iPod controls.
Iphone 3g does not have multitasking, therefore you can only close the app by pressing the square "home button"
with the 3gs and the 4 the home button also closes the application,
but you can double tap the home button to open it from the multitasking menu
Your iphone might already have that version, or maybe the phone does not have service, or also it could be tht the phone has been jailbroken. try doing a reset by holding the home buton, and power button down at the same time until the apple logo appears. Then try again
just go to iTunes from your iphone. Log on to your account and try to download the rigtones again. It should say something like "Item already downloaded. Would you like to reinstall it ? Press OK." That should do it. At least it worked like this with apps i purchased, but had to download again :)
