If it was locked and you donot know the password then the only thing you can do is restore it using dfu mode hold both power and home button until it turns off and restart and show you to connect to iTunes. Then restore it. Let me know what happened.

i entered in my pass code and went on a vacation with out my ipod and forgot my pass code. is their somesort of universal code to enter to unlock my ipod? pllzz help me!!!!!!!!!!
i think that you should just keep on turning your ipod on and off until you can put in the passcode again then try to enter 0000 i think that is usually the code that most ipods have ok hope this helps
Try connecting the ipod to itunes, and setting restore. This will erase the code on the ipod touch. The ipod will allow this to happen with the last computer to sync to it.
Also make sure you have the latest itunes version installed. www.apple.com/itunes
and also that you have the latest ipod firmware. This can be done by selecting "check for update" from the ipod page in itunes.
just hold down the home button, then turn the ipod off, turn it back on, while your still holding the home button. The itunes will then detect it and you will be able to enable it
From what I gather in your post, it seems that your touch has had too many wrong attempts at the passcode, so now it won't even give you the number pad to try again.
It is now necessary to restore the touch on the computer that was used to originally sync it, so you can reset your passcode and resync the data.
If you use a different computer, you will be able to unlock and remove passcode, but you will lose your data.
The link below will explain what I said a little better, and at the end of the article there is another link on how to actually update and restore your touch.
