A Hard Reset is the only way. You just need your Apple ID [email protected] and Password and a computer with the iTunes app on it.
If someone has tried to unlock the phone more that 4 tries, it will also be PUK Locked (SIM Locked) by your Telco. Only they can give you that code, but you still need your own code. You have not given enough information to understand what is going on here? If it is stolen or reported stolen, it will also be PUK Locked so you can't use it.

Connect via the charging lead. Log in to the App with your Apple ID and password and click the Phone icon and click Reset. It will ask if you want to Backup first. Afterwards you can Restore the data with no password on the phone.
