Now you have a real problem. I hope you did setup a recovery mode for your Apple ID, because you have to visit the Apple page and ask them to send you a reset code, so you can reset your ID. It only works when you did setup this before. It won't work if you did not setup the security correct. Goto this page and ask Apple to help you. Follow the instructions.

You can easily create your own Apple ID here: https://www.apple.com/icloud/setup/

But it seems that your particular iPhone is locked via the former owners Apple ID, which gives you no option other than contacting him and asking to delete this iPhone from his iCloud account.
