If it's brand new and leaking, call the place you bought it from and have them fix it. As for the temp settings; there is a center default in the freezer and you should start there, the fridge also has a default which should be OK. If you need it colder turn it up in small increments and give it a day before you make any additional adjustments. The "cold" in a fridge or freezer also depends on how much stuff you have in the unit, and how often you have the door open.

need to kow brand and model # of frig to help / tempts for frig 38 deg and freezer 15 deg or lower to 5 deg .. mm

the probe from the temp panel is not sensing correct temp or the panel itself is bad...call a tech to check it out

the temp controller is bad in the fridge once it reaches cooling temp desired it cause the temp comtroller to go into a shut off mode due to being weak on the temp sensor tube

Since the temperature is already 40°, the cold control is satisfied and will not run. Thus the freezer will warm up to 40°.
