To cancel your membership at the end of the current term, turn off auto renewal by following these steps. With automatic renewal turned off, your membership will expire at the end of its term.
Sign in to the xbox live website by using your Microsoft account. Note Make sure that you sign in using the Microsoft account associated with the Xbox Live account that you want to manage.
Once you've signed in, click My Account
In the Subscriptions section, click Go to Subscriptions.
If you're not on a trusted device, you'll be prompted to choose an existing proof, either your email or a phone number, so we can send you a security code. The code is sent to either your email address or mobile phone.
After you receive the security code, click Next.
Enter the code that you received, and then click Submit.

To play ONLINE Call of Duty then you will need a Gold account. I am assuming that you had bought a 3 month membership to Gold and that is why it has run out?
If the Xbox 360 is used then you still might have a few free trial periods free for 1 month Xbox Live. If I recall previously you could load up to 4 trial accounts. So try just creating a new user profile and see if it doesn't give you one month free for that account? If not then the previous owner has used all the trial accounts.
Make sure you don't use a credit card when signing up to Xbox Live though... it will automatically be set to charge you for renewal when your Gold Account runs out.
If you have to get a Gold account then I recommend you purchase the Live cards at your local store. Some people go onto Ebay and find cheap deals... but I have heard of a few people complain when getting cards that don't work.
Check your subscription, do you still have Gold membership?
If you do not then you cannot play online until it is renewed, but if you are currently still signed up you may have been temporarily banned or the severs could be down.

Form your Xbox 360 you need to be connected to the Internet by a straight LAN line or wirelessly. You can test you connection by going to the setting screen on your Xbox 360.
