Put a passcode on it in settings, then make sure that after you get it wrong multiple times it will be disabled forever, then just keep getting the passcode wrong.
Do I read your question correctly: you want to disable your iPod?
Or do you want to recover it from being disabled?
For the first one, to disable your iPod:
Turn ON the passcode-lock by going to Settings> General> Passcode Lock> ... and then, tap Turn Passcode On.
Now, to disable it, put your iPod to sleep by pressing the POWER button once. Then wak it up. You will be asked for the passcode before you can use it.
Enter an incorrect passcode several times to disable the device.
Go on to itunes and plug your mp3 in to your computer and download it and salect which tunes you want. If it dose not work
there is somethind wrong whith your mp3
Connect to iTunes, go to the settings menu of your iPod (click on the picture of your ipod on the bar on the side.) Then click "restore my ipod's settings," or something similar to that. You will have to re-sync your ipod, but your password will be removed. hope it helps
press and hold the home and power buttons, when it turns off DO NOT let go of the home button continue holding until it restores itself then connect it to your computer and restore it. unfortunately it will erase everything.
