Thats unfortunate but in the world of electronics it's not unusual. My suggestion would be to contact the seller and get them to replace the item or refund you.
If the seller is not helpful and you paid via paypal, then you have upto 60 days to make a claim as 'item not as dscribed' to get your money back or a replacement.

-Plug in your mp3 player
-Go 'My Music' and find your music files.
-Either select all your songs, open them with 'Windows Media Player' and transfer them that way.
-Or 'Open My Computer' then open 'Mp401'or something along those lines, and drag the songs from where your songs are located [My Music] to the 'Music' folder in your Nano Mp401 folder.
[MyMusic] Song.mp3 >drag to> [MyComputer/Mp401] Music.

I get the same kind of issue. I had to re-format each time it froze. I have the 16gb camera edition and I had 10gb of mp3's on it when one day it decided not to respond to touch and resetting didnt work so I re-formatted and re-applied mp3's and it worked til it froze again later on. You get what you pay for from Hong Kong man.

I have similar problem, bought one from eBay , it worked for 5 minutes, when I uploaded new mp3's it began to hang then the touch screen went out of order and now nothing works, just turn on and turn off :(((
