Does the same error occur if you launch a scan from the computer? What OS do you have? Vista only has a basic driver available and does not support the scanner buttons. (You can launch the scans from a number of options: third-party software, Windows Fax and Scan (new scan), Microsoft Paint (File > Import from Scanner or Camera > New Scan) and Windows Photo Gallery.)
If the error occurs when you launch the scan from the computer, try a new data cable and different USB ports. Try a direct USB connection if you use a hub. Then check your USB ports and the drivers for the USB. (For Windows, look in the Device Manager. Start > Control Panel > System > Device Manager (exact directions will depend on the OS).
The HP Photo and Imaging software requires you to set the default scan destinations in the software before you can use the buttons on the scanner (for those OS/driver versions that support the feature). Always open the software and scan from the computer to see what the defaults will be. Each version of HP's imaging software set up these buttons differently; the help option is useful. Try Scan > Scan settings to find where to set the color and black & white destinations.
