There's a couple possibilities. Do you have an Apple ID and can you just log in with that? Or is it popping up with someone else email/username?
If Find my Phone is disabled (as it should have been in order to sell it) you could also put the phone in DFU mode and install a new IPSW (OS) file, which would overwrite everything and make it as if you were taking a new phone out of the box, software wise.
If you bought the phone on eBay or the internet, it most likely has the old SIM card still in it. If that's the case, you'll need to request a new SIM from your carrier in order for it to work. See Christina, it's simple. First you need to select all photos you neeed to download. Then Click options and save them to iCloud Sharing. Then from your Computer, go to iCloud. Login. Then click on your photos. All photos will appear. Download the ones you need and then delete them from your iPhone 5.
