To remove the disc try going to finder, one is display you should be able to see an icon that looks like a disc. Next to it there should be an eject icon, click the eject icon and your disc you come out.

The CD is most likely not a system disk, so if the CD mechanism is functioning properly, it will be ejected. Note: this works on older Macs. In newer systems, it may be ignored. Depends one how you are backing up your photos and other data. Is your Maxtor an external hard drive. Did it come with software that you installed to backup your computer? I would need more information in order to help you. =)
