Restart the computer.
Enter BIOS setup.
Click to "disable" both the COM1 and COM2 (or Serial1 and Serial 2) ports.
Save-and-exit from BIOS setup.
Restart Windows.
The modem should now be assigned as 'COM1', and should work.

In any case, check the event viewer for help.
You might also try running a scan with MBAM just to check for malware that could be contributing to the problem. To do that, I recommend you follow the procedures outlined in this malware removal guide. At least th first four steps.
To deal with the modem error, you should go to the laptop manufacturer's support site and download the driver for your modem. Then use the device manager to check that the correct driver for your actual modem hardware is installed. (From there you can also disable it if you wish, but I don't think that will keep the system from loading the driver.) If you need help with this, here's a good tutorial.
Try that to begin with and report back.

that is a problem with your DIAL-up modem which is the old style, use your phone and dialin type of internet connection. so basically if you're on high speed you dont really need it, you can right click and disable. if the modem is in a desktop in a pci slot, you can actually just remove it all together. code 10 means the device wont start either due to hardware failure or bad drivers...but again, its a dialup modem and oyu're on highspeed so you dont even need it.

Do this

1. unplug modem from computer
2. uninstall drivers
3. reinstall drivers first then
4. install modem
5. check for updates at moto site as well microsoft.
6. swap USB cables if its a plug and play device.
7. check phone line swap for a cat 3 RJ 11 cable not all modular cords are the same
8. Cheapo dollar store or made in china labels on mod cords are decieveing, poor quality as well construction . Buy a Qulaity cord.
9. check phone jack if you own a puppy or kitty the love to mark and green corrosion will mess a jack up. replace if its green ans well the mod cord may be green don't waste time in cleaning it. key word RESISTANCE !
