gears are probably not engaged. take the seat out, see if the motor drive gear is still within the teeth of the seat rail. if not, force it in. Easy to take out, 4 bolts and the seat comes up and out.

Ok you will have to have it scanned. It probably has cylinder misfire codes and random cylnder misfires. You could need spark plugs and or coils. The scan will tell you exactly which cylinder is missing. That will cure your problem and remember to change your oil and filter right before you go in for the smog test. Also if the car hasn't been serviced in a while it would be a good idea to replace the air filter and fuel filter.

Take the seat out and turn it over, to see if the gears are stripped, or if something simply became unattached.
It is needs expensive parts, consider a junk yard, or if really desperate, steal them from the passenger seat. Worst case, just lock it into one position that is best for you.

Very common problem. The white plastic gear in the tilt mechanism gets old and brittle and breaks.
BMW will want to sell you a whole gear box with motor. Aside from the outrageous cost, removing that gearbox is a pain.
Odometergears.com will sell you just the plastic gear for $40, and their website has wonderful instructions that show you how to replace it quickly and easily.
You will have to remove the seat from the car. Put some old socks over the tips of the seat rails that unbolt from the floor because the seat is rather heavy and awkward to handle, and the tips of those seat rails are very sharp and will cut up the interior and exterior of your car if they touch anything as you wrestle with the seat DAMHIK.
The other tip is to be careful not to over-tighten the screws that hold the cover on the gear box, They are not very strong and will twist in two easily. Again.. Don't ask...
Unrelated, but if the leather on your driver seat is shot, you can use the leather from a junk yard passenger seat to freshen up your driver seat. The seat bottom is replaced foam and all. Don't bother trying to save the plastic snaps, just pry the seat bottom up and put in new snaps. The leather on the seat back has to be removed from the seat and transferred, but it is not difficult.

You need to remove the seat from the car. It is rather heavy and awkward. Put old socks over the ends of the seat rails that bolt to the floor because the tips of those rails are razor sharp and will cut your interior, your exterior, and you if you don't cover them
Be careful not to over-tighten the screws that hold the cover on the gearbox. Those screws are not very strong so they are easy to twist off.

Passenger side seat stuck in recline 1996 328i bmw

This is either an electrical problem or the infamous twisted seat problem caused by the cables between the motors and reclining gear units of the power seat.
Check the connector under the front of the seat and make sure it has not been disconnected
listen to determine whether the motor at the front of the seat are turning when you try to move the seat (they are fairly quiet)
If the motor spins, then search internet for "bmw twisted seat"

Looking at the fuze box in a 1996 BMW 328i, the drivers seat adjustment fuse is #40. Where is the #40 fuze located?

The longer single row of fuses is #31-46 (46 is closest to the double row of fuses).

Try adjusting the ''brake'' Its used to keep the window from moving around when your not making it. The motor may be too weak to over-ride the brake. Hope this helps.

The electric motor is located under the seat it may have shorted out. You would have to take the seat out to replace it.
