is there anyway to check and see if its a bad stator? and where is it located?
It's in the side case of the motor. You should see 3 wires coming out of the top of the side case and you can hook up a light tester to one of the wires and try starting the bike to see if its generating power

Squeeze the break handle on the right side then try. Your neautral switch may not be working and it thinks your in gear. By applying the right hand break you over ride the sensor and if she starts you have your answers. The in gear sensor will cut spark so you don't have a run away machine on start up.
