I asked myself this question a few months back after my solicitors in London advised me to settle out of court on a claim I was pursuing.

I've done some research, and according to the information I found on http://www.vaneatonsolicitors.co.uk/ , this is because taking legal action is inherently risky and you can never be fully certain of the outcome, even for an ironclad case.

Therefore, there's always the chance that you will spend a great deal of money on taking it to court, and won't recover any of this cost in the long run.

Even if you win the dispute, the amount you're awarded may not cover the costs of the court proceedings. Therefore, even if you do feel certain you're going to win, resorting to legal action may still not be a cost-effective solution. As a general rule-of-thumb, any claim which has a value of under £10,000 is best settled out of court. If it's over £10,000, it may be worth it.

With no legal document, such as a contract, there is no legal obligation to pay, as text messaging and word of mouth does not constitute a legally binding contract in the court's eyes. You can get an attorney and attempt to take them to court using the text messages, but given you can set a person's name and contact information in your phone manually, they will likely have it thrown out as it is too easy to fake and will likely be seen as non circumstantial. In short, I do not believe you have a case here, not without a legally binding contract.
