When scrolling in any program the window becomes jumpy when I try to scroll up. It jumps up a few lines then back down to where it was before i tried to scroll. I have done all the updates for windows that were available. I tried to instal a mouse update but it said I need 1.1 Net Framework. I currently have 3.5.

Did you install the mouse driver they provided? If so, there should be a SetPoint Settings item in your system tray. Open it and check the Pointer and Scroller Settings and try adjusting the Scrolling Size setting.
This could be due to incorrect mouse settings. It may also be an issue with smooth scrolling in Windows. You can try both disabling and enabling smooth scrolling to see setting performs better. Some related tips can also be found here:
My guess is that the scroll-wheel is being pushed down, even when you don't think that you are touching it. It might be "locking" in the "down" position, thus causing it _not_ to work when you do try to scroll.
I have the same problem running under win7 64 bit, I have just pulled apart my expert mouse\trackball to clean it and found that the scroll ring works by using a little infrared diode ... so no cleaning required ...
the screws for the base are located under the little rubber feet.
So I think the problem may be more related to drivers\software... at the moment I cant find a win 64bit driver or mouse works application anywhere
