Have you tried to connect the drums to the console? You do this by pushing the connect button on the console first, which is a little circular button located on the front faceplate of the console next to the memory card slots. The lights on the light ring should start spinning. Then you press and hold the connect button on the drums controller, and the lights should stop spinning. This should connect the drums. If you have tried this already, let me know.
I have had this problem once or twice myself. For me, I used to be familiar with the Guitar Hero controllers, which were very sensitive. As for Harmonix's rock band guitars, they are not as sensitive as guitar hero's and require a very deliberate motion when deploying overdrive. Next time you're playing, give it a deliberate tilt upward with a decent amount force. Also, if you bought it used, that could be a problem as well. Hope that helps.
have you checked the batteries? also try re-syncing them to the 360. are you using wireless or wired? if wired, sometimes the usb ports get worn out, try using the one in the back above the av port. good luck!
