No it is not illegal recently there has been much speculation.. it does however void your warranty.. but if you restore after you jailbreak there is no way of apple knowing you ever jail break.. but be careful.

Try rebooting the iPhone while it is plugged into your computer with iTunes running. Hold down the home button and the sleep button for a few seconds to reboot it. iTunes should then recognize the iPhone as being in recovery mode and you can then use iTunes to restore your firmware.
