Usually when this happens, the burner end of the drive has gone out and the drive will need to be replaced in order to fix it. On rare occasion the driver glitch, so, try uninstalling the drivers for the drive from the device manager and reboot. The machine will find the drive and reinstall the drivers. If it still doesn't work, then I'm afraid the drive has failed and will need replaced.

Around track 8 in its recording process it breaks up the audio signal so when we duplicate it kick out a error then kicks out the CD's

this could be caued by a few possibilities you might not have select to burn an audio copy or the burning software does not support the burning of audio copies although if it burns a few before being interrupted it probably will support audio burning

the other possible reason might be the cd/dvd burner is not getting continuos power during the burn process

Remove the drive from your computer, and temporarily connect it to another desktop computer.
If it still does not work, then it's time to responsibly recycle it, and spend $40 to purchase a new CD/DVD reader/writer.

How can I find out if my HP Pavilion dv4000 has a DVD burner?

The simple way is to insert an empty disk and try burning the disk with some content. If it burns, that means you have a dvd burner fixed with ur device. Another way which is comparitively complicated is to check the device in the device manager. Right click on My Computer and click on Manage on that. You will get another window opened
In the left navigation pane, you will see device manager. click on that and see your DVD Drive status. If its given as DVD+ RW then you have dvd burner installed in ur system.
