If you've gone TO them and they say that they can't fix it, I would ask for my phone to be replaced because it does not operate correctly.
If they refuse to do this I would call the regional manager and tell them what is happening, and get the phone replaced INDEFINATELY.
If you have a warranty there will be no problem replacing the phone at all, and your information can be pulled off and put on the new one, as well as your contacts, and pictures, and emails.
