Most of the Pirated games are exact copies of certain original copies. If you buy pirated games of your Wii's region, there will be no problem with the updates to be done from pirated discs. There is also no problem if you keep your Wii up to date via WiiConnect 24. However there's the possibility to get banned. However some pirates have managed to take out the firmware updates from games. If you buy them from a certain person, ask him/her if he/she has removed the updates. Be careful though with other region games and some updates that may deactivate your modchip.

the best and easiest way to upgrade the firmware on your wii is to connect the wii to your internet and look for system update in the system settings and update that way. Altthough most games that need newer firmware come with the update installed on the disc, normally once you insert the disc it will tell you it need to update the system firmware in order for the game to work, so i'm not sure why this is not happening for you if your new games not playing. The only thing i can think of if it's not updating automatically is that the wii has been chipped/modded in some way, has it? If it has'nt just connect the wii to the internet you should be able to update it that way.

Turn on the Wii, insert the game and let it load.
Wait as the firmware checker in the video game checks that the Wii's firmware needs to be updated. If this does not happen, it means no firmware checker is on the disc and another game will have to be obtained to try it again.
Follow the directions presented onscreen when the firmware checker has finished checking. The firmware will now be updated.
Eject the video game disc when the update is done and restart the Wii.
It is possible that you updated your Wii with a new firmware that was available on one of the game disks. Some modifications do not work anymore after a firmware update. So it might be possible that you have an older modification that Nintendo overrides with a new installed firmware. It is almost sure that when you remove the modification completely, your Wii is working fine. If so, install a recent modification that is immune for these firmware tricks, dor example the D2Sun
If you mean a pirated copy, you'd have to modify your console to boot those "fakes" Doing so is illegal. It also voids your console guarantee and you may end up banned from WiiConnect24, loosing all the online updates and stuff.
This happened to my Wii till i came across this youtube video. So basically, i look for a file called - wii-ntsc-systemmenu-v289 - paste that into google and you'll find links to the actual file. Burn the iso on a DVD-R then popped it into my wii. Go run the CD and it will immediately ask you for an update. Click ok and let it run. After it updates, volla! i can go to my settings and my current version is now 3.2U.
