You are under warranty I assume from the NEW statement.
Please understand Nintendo is your best option here. Contact them and they will take care of everything. They have wonderful service unlike Sony or Microsoft. And they will also make sure you get your game back that is inside.
If it is out of warranty then also do your self a favor and pay to have them fix it. It will only take about 2 weeks max from the time you call not bad considering they pay all the shipping and treat you like a real customer.
