I have the same problem. Seems like this is a common problem - my phone is quite new and is covered by warranty. I have given it to the service center - will post the solution of what they did to fix it.
I have the exact same problem i have been searching everywhere for a replacement and will post onto this site with a suitable link when possible (not giving up hope - yet). Only suggestion that popped up was remove sticky conductive pad on internal speaker and search by printed part no, not description. Or mug sumone for a htc touch!

This is most likely an internal problem with the phone the actual speaker for when you are making normal calls that are not on speaker phone is damaged or one of the two contacts to the board are damaged or bent so you could do one of two things: 1. Send it in for repairs or 2. Buy the parts yourself and do the repair yourself I find that much cheaper sometimes I go to cnn.cn for my blackberry parts you can find a lot of OEM parts there.
HI, THIS IS VISHU HERE, IT SEEMS THAT THERE IS SOME PROBLEM IN YOUR AUDIO SOCKET.THE SOCKET WHERE WE CONNECT THE EAR PHONE , BCOZ NORMALLY WHEN WE CONNECT THE EAR PHONE ON A GOOD WORKING DEVICE IT CUTS THE AUDIO FROM MAIN SPEAKERS/MIC AND ROUTE IT TO EARPHONES , THIS FUNCTION IS PERFORMED BY METALIC CONTACTS PRESENT WITHIN THE SOCKET THE PROBLEM IS WITH THESE CONTACTS MEANS THESE CONTACTS ARE REMAINING IN CUT OFF POSITION EVEN AFTER REMOVING THE EARPHONE . TRY TO GET UR SOCKET REPLACED , HOPE IT WILL SOLVE UR PROBLEM.
Your ear speaker is bad. You may need to replace it.. This one made by HTC. You can check on Ebay for replacement part. Other issue could be is the hardware part of the ear speaker may be broken or defected will cause loosing contact with the main circuit or you can say it is short. Only solution is open the phone and check for that area to see for any defective.
