OK, you do have a couple of options:
According to Apple, if you have forgotten the code, you can unlock the iPod by doing the following: Connect your iPod to the primary computer you use it with (the first one iPod synced with), and open iTunes. When you disconnect iPod from the computer, it will no longer be locked. If you can't unlock iPod using either [the code or connecting it to the computer you use to manage its songs]. . . you can restore your iPod to factory settings using iPod Updater. Please note that this will erase all data on your iPod. Afterwards, you can add your music and data back to your iPod. If you want to change the primary computer that your iPod is associated with, do this: 1. Restore your iPod. Warning: The restore process cannot be undone. All of your songs and files will be deleted. Always make a backup of your important data. 2. Connect your iPod to the computer that you want to be the primary computer. 3. Open iTunes and synchronize.

If you have access to a Mac, the easiest way to remove the lock on an iPod is to use Terminal. Open a Terminal window and you will need to go into "/Volumes/(iPodname)/iPod_Control/Device". There will be a file in there called "_locked". type "rm _locked" and you will be returned to the normal terminal prompt. Eject your iPod and the lock will be removed.

Here you go:
See the paragraph below on that page, you should be good to go!
If you don't know your code -- which is why you're reading this article in the first place, I bet -- then here's the bad news: the only way to get around the combination is to restore your iPod to the factory defaults, which means that it'll wipe out all your music, all your videos, photos, games, anything you've put on it. It'll end up as if you'd just pulled it out of a box, brand new.

SOURCE: ipod lock code
If you can't remember your lock code on your Nano, you will have to restore the Nano via iTunes, there is no other way around this, as there is no way to recover your lock code.
Restoring your Nano will erase everything on the player, and restore it to factory defaults, after this is done you can restore all your files and settings to your Nano.
Here is instructions on resoring your Nano in case you aren't sure how.
