To play ONLINE Call of Duty then you will need a Gold account. I am assuming that you had bought a 3 month membership to Gold and that is why it has run out?
If the Xbox 360 is used then you still might have a few free trial periods free for 1 month Xbox Live. If I recall previously you could load up to 4 trial accounts. So try just creating a new user profile and see if it doesn't give you one month free for that account? If not then the previous owner has used all the trial accounts.
Make sure you don't use a credit card when signing up to Xbox Live though... it will automatically be set to charge you for renewal when your Gold Account runs out.
If you have to get a Gold account then I recommend you purchase the Live cards at your local store. Some people go onto Ebay and find cheap deals... but I have heard of a few people complain when getting cards that don't work.
You will need some kind of internet connection so you will use either an Ethernet cord or a Wifi adapter. After you connect to the internet through your Xbox 360 you will have a 1 month free Xbox live trial. When the trial ends you will either use an Xbox live silver subscription which doesn't allow you to play games on-line, use Netflix, etc. Otherwise you would need to buy an Xbox live gold pass which is a better deal as you purchase a longer subscription. make sure your xbox connects to internet. then set up an xbox live account. you can use a free trial but will need to either go to a game store and buy gold membership card or buy one with a credit card. until then you will remain a "silver" which doesnt let you do anything really.

click on your account and select"join xbox live"
when you register you will be started off with a free trial
go to gamestore and buy an xbox live gold membership monthley card or buy a gold member ship online. once your trial runs down you will live off a silver account which doesnt let you join partys, play online with friends,etc.
well for one you need an xbox live account, if your console is new and this is your first time connecting i believe you will have about a month free gold trial membership, use that to download the free or pay on demand games, some good games are limbo, hope this helps
yes it would tell you if live had expired ! did you buy the xbox new or used ?? if used it is possible it has been banned from live access ?? if it has been banned buying a new harddrive wont get it back on ! if you bought it new & have never had a live account before then take the free month trial befor you use the 3 month u got ! just go thru the process of signing up to 'silver' membership ! what eva it asks (as it does a few times) refuse 'Gold' membership ! and select 'Silver' !! if it hasnt already had the free 1 month trial it will say at the end of signing for silver.....to try gold for a month to see what ur missing ! :-) after the month is up...use the 3 month you got !
