Turn iPod touch off and turn it on again.
If the iPod will not turn off, try to reset it. Press and hold the
Sleep/Wake button and the Home button at the same time for at least ten
seconds, until either the Apple logo or battery symbol appears. If the
battery symbol appears, continue to charge iPod touch until it is fully
charged.
If this doesn't work, try restoring the iPod

Most iPhone / iPod Touch problems can be solved by a restore:

if you dont mind losing your music try a shift restore on the firmware, you can download official firmware just put go to your itunes and look at you ipod and what the newest fw out is and then google it download it, and go to itunes and on the restore tab hold down shift and click on restore this will allow you to restore from current firmware and hopefully the reset will fix the problem
This is actually really easy to do.
This called a hard reboot.
All you have to do is hold the home button and the power button down at the same time for 30 to 40 seconds or until you get a Apple sign on your screen.
This will reboot your ipod.
If this does not work there is one other thing you can try to do.
Hook your ipod touch up to your computer that you use itunes on.
Itunes will detect a problem with your ipod.
You can try a restore of your ipod from your computer.
If this does not work its time to return or send your ipod back to apple so they can repair it.
hope this helps
