Digital Audio TRIO MP3 Player

Won't turn on

I bought a audiophase digital 1GB MP3 player as a gift for a niece in April 07. Opened the packaged Christmas day, installed the battery and the MP3 player won't turn on. Changed the battery and the MP3 player still won't turn on. The store I purchased it from won't replace it because it's been over 90 days from date of purchase. What to do?
