I have recently returned to university after spending the summer at hom, where there is already a 360 plugged in, so i recovered my gamertag to there, everything was fine and dandy. I get back and am faced with a 'New Update' I go onto it, it moves to download, then says its unable to connect and fails. I checked to see if id set anythign up wrong but according to the test it can connect just fine to the internet through my router, but cant finish testing xbox live as this update is required. I have tried multiple times to download this, even at one point getting so it HAS downloaded, restarted the console and then guess what? the ;Cant download this update' page springs up again. I have tried using microsoft's system - where you copy the files to a cd and then put it in the machine. It doesnt work. Seems like they have messed up yet again.

It sounds like you've refused an Xbox Live Update at some point.
You can go into your system options and see if there's an update available.
To check for an update on the Xbox 360 you basically force a new Xbox Live connection:
Press the Guide button (center logo button), bringing up the pop-up menu
Go to Settings
Select System Settings
Select Network Settings
Select Wired Network or the name of your wireless network if you're on wifi
Select Test Xbox Live Connection
Select Yes if prompted to update. If you're not prompted and the test completes successfully, you have the most recent update.
Recently Microsoft released a Dashboard update for the Xbox system in the last couple of days. It could be that its wanting to update that. Or it also could be the Netflix application wanting to update as well.
If you already have the Spring 2010 Dash Update for the Xbox 360 console this can be configured( go to Setting up your Xbox 360 with your USB Flash Drive). The update allows you to configure a flash drive to hold up to 16GB of Xbox 360 games, gamertags, videos, and other information. You can connect two USB storage devices to your console at once.
If you don't have it yet, you need to download the update:
To install the update through Xbox LIVE 1. On your Xbox 360 console, sign in to Xbox LIVE. 2. Select Yes, updated now when prompted. 3. When you see the new Dashboard, you're done. Setting up your Xbox 360 with your USB Flash Drive:1. Plug the USB flash drive to the Xbox 360 console. 2. On your console, go to My Xbox, and then select System Settings. 3. Select Memory. 4. On the Storage Devices screen, select USB Storage Device. For detailed instructions you can visit: http://kb.sandisk.com/app/answers/detail/a_id/2777
The easiest option to update the Xbox 360 hard drive is to connect to Xbox Live. The console will automatically prompt the user to install any available updates. Alternatively, users can download the update files to a USB flash drive to transfer to the Xbox 360 hard drive.
Update via Xbox Live
Open the Xbox 360 dashboard menu. This menu automatically appears when the console is turned on. Press the "Xbox" button, followed by the "Y" button to return to the dashboard menu from a game.
Scroll up to the "My Xbox" tab of the dashboard menu.
Select "System Settings" from the "My Xbox" section of the dashboard. Scroll to the right while the "My Xbox" tab is selected to reach the "System Settings" icon.
Select "Network Settings" from the "System Settings" menu.
Select "Test Xbox Live Connection" from the network settings. A prompt will appear to update the Xbox 360 hard drive if your system is not already updated to the latest version.
Select "Yes, update now" to install the latest updates to your Xbox 360 hard drive.
Updating via USB Flash Drive
Copy the update files onto the root directory of your USB flash drive. You can download the Xbox 360 update files by going to download.microsoft.com/download/1/d/8/1d8c09be-278e-41cd-98be-eb9188128227/$systemupdate9199.zip. You must extract the files from the .zip file before placing them on the USB drive. The update files cannot be placed into a folder or the Xbox 360 system will not recognize them.
Remove the flash drive from your computer.
Insert the flash drive into the USB port on the Xbox 360 console.
Turn on the Xbox 360. An update prompt will appear when the system powers up.
Select "Yes, update now" to update the Xbox 360 hard drive.
the odds are very good... The error is caused when there's a problem with video, either because
the A/V cable used is broken, or what's even worse, when Ana, the Xbox
360 hardware scaler chip is damaged.
Also try this take the AV cable, plug it out and plug it in, if it still
doesn't work unplug it, wipe the metal part with a soft cloth then
plug it in. That might help. But i bet you will end up sending it off again.
