i fuly charge my ipod and it only lasts about 3 hours my backlight it nearly black and i press the of button it just flickers back on agin and wont turn off do i ned a new battery?

The ipod nano battery can be replaced. There is a stepby step guide that explainshow to repair the jack as opposed to replacing it : iPod nano repair. There are also third party iPod nano repair companies that do it for you.

sounds like the iPod needs a new battery, or just some internal repairs. you're going to have to send this in to the repair center, to avoid voiding warranty. unfortunately, there isnt much the end user can to to repair the iPod, so its either that, or buy a new iPod.
