I think it is that you might have to restore your ipod to its original firmware and reinstall the apps. If this doesn't help, call apple and let them fix your itouch. Also these days, anyone that jailbreaks their itouch gets their itouch screwed because apple does not allow jailbreaking.
mine does this sometimes also, i'll be in a program and i hit the home button and the music/ close menu will pop up. i hit close or hold down home and it goes back. there was a new update to the unit so that might fix it also
