This seems to a problem the spring is not that easy to get but you try giving it local hardware service center and get it fix but make sure you explain to them clear this is problem ............

Put the Brake spring under the gas pedal (think its the same part) and then get a "Squash Ball" (small hollow ball for the game Squash) and tape that in place of the spring, you brake pedal will now feel more firm like a real car....

Under the seat, there is a operator presence switch, if this switch fails, the mower will shut off when the brake is released, or put in any gear.

Nix on safety switch. If it was a safety switch, you would not hear a click when you turned the key to start.. There would be no power going to the solenoid. However, if your engine has the fuel shutoff solenoid beneath the carb bowl, it will make a faint click when you just turn the key to the 'on' position. Probably as thabrain says, a bad solenoid.
