discuss the problem with the attorney but generally if they are not telling you of what they are doing , you might consider that they are not working for you

Call the company or the issuing bank and ask them. For security reasons I don't think I would post this question on the WWW. Or another option is to pay a lawyer good money to do just the same. His advice would probably do a "power of attorney" and give you the legal stance on his affairs.

Who is entitled to be power of attorney? I am divorced and have a dependant child of 16 years old and a 21 yr old. we are divorced , but have a dependant child, would I be the power of attorney?


not unless that is decided by the court or a person in a responsible position
you just cannot demand a power of attorney from any one for example the 16 year old is not of adult status so no
the 21 year old could be if you were proved mentally incompetent but that would be decided by the court
instead of asking fixya site , would it not be better to get proper legal advice from a lawyer

If there is a legal self help group in your area, contact them. Google legal self help in your state and city. If you are lucky you live near a college or university that has students look at these types of issues for practice and it won't cost you anything for their help. They can get you started with a small claims court action. The Nolo Press books for legal help are especially good; I've included a link to the California Small Claims Guide for example.
Also try your local Better Business Bureau, State Attorney General's Office, Consumer Protection Agency.
Have ALL of your documentation organized and try not to get emotional when asking for help.
If small claims court isn't available to you, you'll need a lawyer that specializes in automotive repair issues & lemon law issues. But you may end up spending more in legal fees than you could possibly collect.

Legally yes...you need to send them legal notice of intent that you will take leagal action if th eunit not fixed on time and if the unit kept broken you will take it to outside service tech and charge them. The state that if you take it more than reasonable times for the same issue you can take it to repair service and charge them or it or get your money back cehck with local attorney for more details on consumer actions.
