If you have the original receipt or can go back to the store to get a copy, you can contact apple and they will start the process of removing that Apple ID from the device. It will need to be from an authorized apple reseller like your carrier, Best Buy, etc.

We will remove her apple ID first and then we will
Settings -> Store -> Scroll down to Store -> At the bottom click on Apple ID -> Sign out
Sign in with your own Apple ID.

All Apple devices have what is called an activation lock. If the incorrect Apple ID was still logged in when you did the factory reset, it will prompt you to log into that Apple ID before you can proceed through setup. Once you have done so, you can log out of the incorrect Apple ID and into the correct one.
This is a security feature that Apple has written into their software to deter theft of iPhones.

You can't. Apple won't help you either. They will alway assume that it is stolen unless you have proof that you are the original owner
