jake brakes have a separate isolation switch , that the operator can used to turn of the jake brake when that operation is not required
many vehicles have the jake brake connected to a switch/ sensor on the accelerator pedal or linkage to operate as you describe and the power for that switch/ sensor comes from the switch that I mentioned ,in the dash or steering wheel controls
A make and model of engine , vehicle would be a help but what I mentioned is basic to all models of operations

Jake brakes are controlled by electro-mechanical solenoids that are screwed in the Jake housings on top of the camshafts and rocker arms. Oil passes through these solenoids when they are switched on, and oil pressure is what opens your exhaust valves up to use the engine as a brake. Sounds like you have one or more of these solenoids that are stuck on, letting oil by all the time. Another thing could be a bad Jake Brake On/Off switch, letting power by even if it's off... (doubt that would be it though, but it could be)

The jake brake is actually built right onto the heads they block your exhaust to slow down compression. Its actually called an engine brake. But if you wantvto remove them you will have to order new heads but why not just turn the switch off for the jake brake or maybe replace it

Both the units are controlled by the revs of the engine. Below certain rpms or road speed both will shut off. Replace the switch if that is faulty. If you accelerate the jacke brakes will come off until you lift your foot. Check the circuirtary for the cruise control and you will probably find that it is also controlled as to cut out when the jake brakes are on.
