My niece has file bankruptcy and refuse to pay me for a loan of $1200.00, how can I get my money I'm retire Military From Detroit Living in Georgia and I need help

First I wonder if this place is more of a type of chat room than a answer from "knowledgeable in the field of the question"? This OP never said he did not have a contract or "it in writing". The real answer should be to tell him to petition the bankruptcy court to get paid out of the nieces estate. A proof of claim is a written statement that notifies the bankruptcy court, the debtor, the trustee, and other interested parties that a creditor wishes to assert its right to receive a distribution (pay out) from the bankruptcy estate. In most Chapter 7 and Chapter 13 bankruptcy cases where there are assets to distribute, creditors must file a proof of claim in order to get paid.

Good answer from ray, there is nothing you can do without a contract ( mabe a small claims court or the threat of one ) but as she is part of your family why dont you have a word with her father ( your brother ? ) or her mother ( your sister ? ) because if it was my child who had done that i would pay you myself and take it off my daughter each week

Your personal bankruptcy should be a minimum of 4-6 years with respect to the loan products there mustn't be any late payments, charge-offs or collection products in your report because the personal bankruptcy. My niece got a loan from me in the amount of $1200.00 Jul of last year check # 18884539, well in Oct 14 she file for Bankruptcy Chapter 13 so how do I get my money back.


I am not a lawyer and you may not like my opinion but probably you can legally kiss the $1200.00 goodbye. If you were not added to the register of people owed money when the bankruptcy was filled your only recourse will be if she values family and has the ability to express remorse and chooses to pay back the money.
