After getting the tv and setting it is freezing constantly or rebooting itself, I tried a factory reset and the problem persisted. Tonight I did a factory reset but did not connect it to my network, and am running netflix through my xbox, thus far I have not had a reboot or freeze issue.. could this be because the firmware was not updated?

If you can get into the setup program, try doing a factory reset to get back to the default setup settings. This may cause you to lose apps that you have added to the set, however, but that's better than having to buy a whole new set. You also may want to see if there are any updates for the set from Visio if you don't have it set up to download and install them automatically already.
