Firstly you need to have a will established if you dont already, that clearly nominates where you want you estate to go to.
No the estate does not have to be shared.

Go back to the court... or judge... that specified the amount of child support your husband was to give you. Or, if you were never married to the father, that makes it more difficult.. You would have to go to a lawyer and start proceedings against the father in order for you to be awarded child support. I hope I've helped a little...
