Yes for sure you must not accept a damaged piece as your money should be worth for a new one. so contact the supplier and make you point clear, take a photograph of the damaged watch and mail to them to confirm before you send it back as if their representative can call on to address the issue.
Make it also clear that there was irresponsibility that the instruction leaflet was also not inside the box.

I suggest you have to pop in to your nearest watch repair shop and ask watchmaker to take a look at clasp first.I t is impossible to tell if the clasp is repairable or not over the internet, as there are plenty of possible causes to make it pop open. If the watchmaker will tell you that there is no chance to repair it, then you will need to contact AKRIBOS yourself.
