Chances are pretty good if you simply replace your old garage door system with a new one, you would not be entitled to any compensation.

If you want peace with your neighbors, just replace the old system and call it good.

If you can't replace it right now, or you really want the neighbor to take responsibility, then I would recommend that you send a letter to the neighbor that outlines the problem very specifically and inform them that they cannot continue to open your garage door and leave it it open because you are concerned about the pipes freezing and about intruders breaking in. Remind them that this problem did not exist until they installed their system and you would really appreciate their assistance in getting this problem resolved.

You do not have a cause of action against the company that installed their garage door system because you didn't have any type of contract with them. You do potentially have a cause of action against the neighbor. Have you considered having an independent garage door installer come out and assess the situation? Just because the tech from the original installation company was clueless doesn't mean another company wouldn't be able to fix this.

Last year, I got a brand new garage door and it kept opening up my neighbor's garage door as well. It turned out that we had the exact same type of garage doors that were happening to work on the same frequency. Have your neighbor bring over his remote and open or close your door with it. Then hold the smart/learn button in for 6 seconds on your opener. Then see if he can open your door. He shouldn't be able to because that procedure erases the memory in your opener. No remotes should work. You need to get that remote #53778 back and program it and then see if your neighbor can open your door. If he can open your door at any point after you have held that button in for 6 seconds you need to get a new door opener.

I have a feeling your neighbor operated their door opener when you were programming your new clicker. Try erasing the memory of your opener and then program the clicker again making sure your neighbors do not operate theirs at the same time. To erase the memory hold the smart/learn button in for 10 seconds.

Have you seen the neighbor open your door? The reason I ask is because it is almost impossible. The most common cause of a door opening by itself is a bad wall control or the wiring leading to it. You can temporarily eliminate both possibilities by removing the wire from terminal 1 at the rear of the motor unit. Do this and ask your neighbor to bring over his remote and try it on your opener.

Do you have the option to change the electronic codes on your garage door opener system? My father-in-law had the same problem a number of years ago. He had not reset the code (equivalent to the combination on a lock) from the equivalent of 0-0-0 (which his unit shipped with). Turned out that a neighbor (or neighbour - in Canada) had the same /similar unit and when the neighbor opened 'his' door, my father-in-law's door would also open. You don't have to see the person drive by - it can be the neighbors behind you as well. You may find a solution by determining if you can change the original electronic code to a different one of your own choosing.
