The gasket is not seated properly, you might have to remove it and clean the area where is sits there might be a small amount of coffee grounds or oil preventing the gasket from seating properly.

You may have a broken silicone seal, or a cracked filter ring. You can see an example of the small cracks on the ring on a photo at this website: http://www.vancouverwireedm.com/caferomadiyt.htm , just under the screw hole in the top corner.
