That might meaning that's it's draining the residual charge left on the battery, before it can be charged, but if it does this for more than an hour, your battery is "toast".

why bother as it is under warranty and not working , take it back for another one or a refund

Can you confirm the actual model number of this set? Some had issues with the picture tubes being bad but depending on model number there may be a fairly easy way to adjust around this to correct the issue.

Your battery is shot you need to replace battery.When the red light blinks it means the Battery wont take a charge this normally happens if the battery is left on the charger longer then needed to charge. They sort of burn up on the inside.

0) Obviously, helicopter will operate best when fully charged... if charging light gets brighter when unplugged from helicopter, then it's not at full charge. Charge fully, then allow battery to cool for 10 minutes. Good batteries in remote also.
1) Power on helicopter.
2) Place on level surface and let gyroscopes sync. There is a red light inside the body (NOT the red/blue flasher in the nose) that will blink when you turn helicopter on, and will keep blinking until craft is level and stable for a few seconds, then will stop blinking.
3) Make sure left joystick is all the way down.
4) Power on remote.
5) Throttle up (left joystick) until blades move and then all the way back down.

mine shows the orange light while charging but never turns blue no matter how long i charge it and it wont turn on. i only used it for 1 hour before it shit out on me. i got it on ebay so i dont know what to do
