my phone charges till full but then the battery runs out really fast, usually after one or two calls, sometime even less. i'm not sure if it is the battery problem, because i'm unsure if the battery is new or not. but would this sound like a defected phone? or is it more of a battery problem?

Could be either honestly. What kind of condition and how old is the phone? Has it been wet or excessively dropped? If not it is more likely the battery. If it is less than a year old Nokia should still honor the warranty and replace it.
