Sound emanating from both the internal speakers and headphone/earphone while the later is engaged could mean a factory defect in your speaker device. Upgrading your OS from XP to Vista may not solve your problem. However, since the service center technician will probably insist on his diagnosis and recommendation, you may need to upgrade your OS just to prove your point.

Computer wont recognize the device, it makes a weird sound when you plug it in, not the usual sound when you plug hardware.

Does the sound come from the device itself or your computer speakers? If its coming from your adapter itself the their something physically wrong with it. I suggest returning it or getting a new one.
